1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter "Customer") and zahnmedia (hereinafter "Seller") regarding the goods presented in the Seller's online shop. Conflicting or deviating terms and conditions of the Customer are not recognized unless otherwise agreed.

1.2 These Terms and Conditions shall apply accordingly to contracts for the delivery of vouchers, unless otherwise agreed.

1.4 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

1.5 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

Conclusion of contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers, but rather an invitation to the Customer to submit an offer.

2.2 The customer can submit the offer via the integrated online order form in the seller's online shop. By clicking the button that completes the ordering process, the customer submits a binding offer to order the goods contained in the shopping cart. Alternatively, the customer can also submit the offer via email, online contact form, or telephone.

2.3 The seller may accept the offer within five days:

  • by sending a written order confirmation or an order confirmation in text form (fax or e-mail), whereby receipt is decisive, or
  • by delivery of the ordered goods, whereby the receipt of the goods is decisive, or
  • by requesting payment after placing the order.

If several of the above-mentioned alternatives exist, the contract is concluded at the time one of the alternatives occurs first. The period for acceptance of the offer begins on the day after the offer is sent by the customer and ends on the fifth day after the offer is sent. If the seller does not accept the offer within this period, this shall be deemed a rejection, with the consequence that the customer is no longer bound by their declaration of intent.

2.4 If a PayPal payment method is selected, payment processing will be carried out via PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, in accordance with the PayPal Terms of Use, available at the specified URL. If the customer pays via PayPal, the seller declares acceptance of the customer's offer when the customer completes the order process.

2.5 When using the "Amazon Payments" payment method, payment processing is carried out via Amazon Payments Europe SCA, 38 Avenue John F. Kennedy, L-1855 Luxembourg, in accordance with the Amazon Payments Europe Terms of Use, available at the specified URL. The seller accepts the customer's offer as soon as the customer completes the payment process by clicking on the order button.

2.6 After the contract has been concluded, the Seller will save the contract text, which it will send to the Customer in text form (e.g., email, fax, or letter) after the order has been sent. The Seller will not make the contract text available beyond this time. If the Customer has a user account in the Seller's online shop, the order data will be archived on the Seller's website and can be accessed there free of charge by providing the login data.

2.7 Before placing a binding order, the customer can identify input errors by carefully checking the information displayed and correcting them using standard keyboard and mouse functions until he completes the order process by clicking the corresponding button.

2.8 The contract is concluded in German.
